VILUZ | TERMS & CONDITIONS
The present Terms & Conditions regulate the services offered by Viluz.
The acquisition of any of the services entails the full and unreserved acceptance of each and every one of the Terms & Conditions indicated, without prejudice to the acceptance of the Special Conditions that may be applicable to the acquisition of certain services.
These Terms & Conditions may be modified without prior notice, therefore, it is advisable to read carefully its content before proceeding to the acquisition of any of the services offered.
Viluz, in compliance with Law 34/2002, of July 11, Services of the Information Society and Electronic Commerce, informs you that:

If you make a reservation with Viluz through one of our digital channels, these booking conditions and any other written information that we brought to your attention before confirming your reservation will apply.
Please read these Terms & Conditions carefully as they explain several important matters and describe our respective rights and obligations.
“You” and “your” refer to the primary person on the reservation as well as any persons on whose behalf the reservation was made. The Site is owned by Viluz, and if you make a reservation, your booking is with us.
By making a reservation, the primary person on the reservation agrees on behalf of all individuals listed in the reservation that:
They have read these Terms & Conditions and have the authority to be bound by them;
They consent to our use of information in accordance with our Privacy Policy;
They are over 18 years of age and, when placing an order for age-restricted services, declare that they and all members of the party are of appropriate age to purchase these services;
They accept the financial responsibility to pay for the reservation on behalf of all individuals listed in the reservation.

All notifications and communications between users and Viluz will be considered effective, for all purposes, when made through any of the means detailed above.
2. SERVICES
The services offered, along with the main characteristics of the same and their price appear on screen.
Viluz reserves the right to decide, at any time, the products and / or services offered to customers. Thus, Viluz may, at any time, add new products and / or services to those currently offered. Viluz also reserves the right to withdraw or cease to offer, at any time and without notice, any of the services offered.
All this without prejudice to the acquisition of any of the services can only be done through subscription or registration of the USER, giving by Viluz to the person concerned a username and password, which will identify and enable you personally to access the services.
Once inside https://www.Viluz.es, and to accede to the hiring of the different services, the User will have to follow all the instructions indicated in the process of purchase, which will suppose the reading and acceptance of all the general and particular conditions fixed in https://www.Viluz.com.
3. RESERVATION
Follow the instructions on the website to make a reservation with us. To confirm your reservation, please provide credit or debit card details.
Please ensure that your reservation details are accurate before submitting your reservation request. We cannot be held responsible for any delays or failure to process your reservation if you provide us with incorrect information.
Your reservation will be confirmed once we send you a confirmation containing a valid confirmation number, establishing a binding agreement between you and us. Upon receipt of the confirmation, if you find any inaccuracies or wish to make changes, please contact us immediately, as changes cannot be made later.
We reserve the right to reject a reservation and decline to provide a confirmation at our discretion.
4. AVAILABILITY AND SUBSTITUTIONS
Viluz intends to guarantee the availability of all products that are advertised through www.Viluz.es. However, in the event that any requested product is not available, the customer will be informed by email when the product is available as soon as possible.
If the product is not available, and having been informed of this the consumer, Viluz may provide a product of similar characteristics without price increase, in which case, the consumer may accept or reject it by exercising their right of withdrawal and termination of the contract.
In case of unavailability of all or part of the order, and the rejection of replacement products by the customer, the refund previously paid, will be made in the same way in which the payment was made
If Viluz is unreasonably delayed in returning the amounts paid, the consumer may claim double the amount owed.
For the provision of services, Viluz, will provide access as follows: By user and password.
Viluz is not responsible for any damages that may occur to the USER as a result of failures or disconnections in telecommunications networks and cause suspension, cancellation or interruption of service https://www.Viluz.es during the provision of the same.
5. PURCHASE AND/OR CONTRACTING PROCESS
To make any purchase in https://www.Viluz.es, it is necessary that the customer is of legal age.
In addition it will be necessary that the customer registers in https://www.Viluz.es through a data collection form in which Viluz is provided with the necessary information for the contracting; data that in any case will be truthful, accurate and complete about his identity and that the customer must expressly consent by accepting the privacy policy of Viluz.
It is also recommended that the customer print and / or keep a copy on a durable medium of the conditions of sale when placing your order, as well as proof of receipt sent by Viluz by email.
INVOICING
Together with your order, you will receive the corresponding invoice.
For this purpose, the customer agrees that the invoice will be sent in electronic format.
6. PRICES, EXPENSES AND TAXES
The prices of the services listed in https://www.Viluz.es will be expressed in Euros unless otherwise stated and will be guaranteed during the time of validity of the same, except for printing errors and whatever the destination of the order.
SERVICES
The prices of the services may vary at any time. In this case, the price to be applied will be the one in force on the date the order is placed. In any case, the final cost will be communicated to the customer in the electronic purchase process before the customer formalizes his acceptance.
All services include VAT.
The VAT rate is 10% for overnight stays, food, and non-alcoholic drinks.
The VAT rate is 21% for soft drinks, treatments, and additional services.
7. PAYMENT FOR YOUR RESERVATION
You can settle your payment in cash or by credit/debit card or by Paypal.
Depending on your booking type, full prepayment of the reservation amount may be required at the time of booking. The total reservation amount can be charged to your credit/debit card anytime between booking and the check-in date.
If you haven’t paid the full reservation amount at the time of booking, you must settle the entire sum upon arrival at Viluz.
Failure to complete all payments in full and on time may lead us to assume you wish to cancel your reservation. In such cases, we reserve the right to retain all amounts paid or payable up to that date, and you will be liable for any cancellation fees outlined at the time of booking.
Any additional charges (e.g., treatments, extra meals, extra overnights, shop purchases,… ) must be settled directly with Viluz before check-out.
8. RETURN AND WITHDRAWAL POLICY
According to the regulations, the consumer and user will have the right to WITHDRAW from the contract for a maximum period of 14 calendar days without stating the reason and without incurring any cost, except those provided for in art. 107.2 and 108 of RD1/2007 of 16 November, which approves the text referred to in the General Law for the Protection of Consumers and Users.
This right of withdrawal is not applicable to, among others:
Provision of services already performed or started.
Contracts for the supply of products made to the specifications of the consumer and user or, clearly personalized, or which by their nature cannot be returned or are likely to deteriorate or expire rapidly.
Contracts for the supply of sound or video recordings, discs and computer programs that have been unsealed by the consumer and user, as well as computer files, supplied electronically, capable of being downloaded or reproduced immediately for permanent use.
The provision of accommodation services or services related to leisure activities, if the contract provides for a specific date or period of performance.
SERVICES
The deadline to withdraw from the contract for the provision of services is 14 calendar days from the day of the conclusion of the contract, the user must inform Viluz their desire to exercise this right, which may be done by filling out the form at the end of this document.
The exercise of the right of withdrawal results in the suspension of the service.
Viluz will communicate to the consumer on a durable medium an acknowledgment of receipt of such withdrawal.
The withdrawal implies that Viluz will proceed to refund the amount already paid by the customer within a maximum period of 14 calendar days, following the same procedure chosen by the customer for its payment (provided that the contracted service is not within the exceptions listed above).
Once we receive your request we will contact the customer to indicate the details of the refund.
9. CUSTOMER SERVICE AND COMPLAINTS
To file any complaint or claim with Viluz the customer should contact the customer service department.
According to the EU Consumer Online Dispute Resolution and in accordance with Art. 14.1 of Regulation (EU) 524/2013, we inform you that the European Commission provides all consumers with an online dispute resolution platform available at the following link: http://ec.europa.eu/consumers/odr/.
10. APPLICABLE LAW
The present conditions shall be governed by the Spanish legislation in force.
The language used shall be Spanish.
